PARTICIPANT WAIVER & HOLD HARMLESS AGREEMENT THE FACTORY SPORTS, INC. I/WE, the undersigned, participant of activities at The Factory Sports, Inc. being of lawful age and sound mind, are engaging in and undertaking various sporting activities at The Factory Sports, Inc. facility. The undersigned hereby understands and acknowledges the risks present in participating in these activities at The Factory Sports, Inc., and they understand and acknowledge that while The Factory Sports, Inc. and its owners, managers, and other agents make strides to minimize the risks present to participants, not all risks can be eliminated, as participating in sports and the similar activities at The Factory Sports, Inc. are inherently dangerous activities. The undersigned participant hereby waives any prospective claim against and hold harmless The Factory Sports, Inc. as well as all agents, staff, and employees of The Factory Sports, Inc. for any and all activity conducted by the participant at any The Factory Sports, Inc. facilities, and waives any prospective claim for any possible injury or damages sustained as a result of their participation in activities at The Factory Sports, Inc. The undersigned to this release do hereby remise, release, acquit and forever discharge and hold harmless The Factory Sports, Inc. and its successors and assigns, from any and all actions, causes of actions, claims, demands, damages, liabilities, suits of any kind, including, but not limited to claims for consequential, punitive and exemplary damages, on account of all damages and injuries, known or unknown, which have resulted or which may result to them, or any agents, employees or any persons acting on their behalf as a result of participating in any activity at The Factory Sports, Inc. The undersigned states that they have carefully read the foregoing or had it read and explained to and that they know and understand the contents and meaning of signing this document. The undersigned executes this release as their own free act.
